The BIM requirements, section by section
The threshold values 2026–27
| Limit | Amount excl. VAT | What happens at the threshold |
|---|---|---|
| Negotiated quotes, at least two quotes | 300,000 | Public contracting authorities must obtain at least two quotes (the Tender Act s. 12) |
| Negotiated quotes prohibited | 3,000,000 | Above the amount the works contract must go to competitive tender (the Tender Act s. 12) |
| BIM, the state and construction the state finances by at least 50 % | 5,000,000 | Executive order no. 118/2013 s. 1(1), nos. 1–3 — at the amount or above |
| BIM, municipalities and regions | 20,000,000 | Executive order no. 118/2013 s. 1(1), nos. 4–6 — at the amount or above |
| BIM, social housing | 20,000,000 | Executive order no. 119/2013 s. 2 — new build and supported renovations |
| EU tender for the works contract | 40,313,840 | The Public Procurement Act, e.g. an open procedure with at least a 35-day deadline |
| Lots, building and civil works | 7,460,000 | Lots below the amount can be kept outside the EU tender, at most 20 % of the total value (the Public Procurement Act s. 8(2)) |
| Lots, supplies and services | 596,800 | Same rule for advisory work and other services |
| Advisory work, advertising on udbud.dk | 100,000 | Where there is clear cross-border interest (the Public Procurement Act ss. 191–192) |
| Advisory work, market terms | 500,000 | Without clear cross-border interest (the Public Procurement Act s. 193) |
| Advisory work, EU tender — central government | 1,044,400 | Part II of the Public Procurement Act |
| Advisory work, EU tender — local authorities, regions, social housing | 1,611,360 | Part II of the Public Procurement Act |
The threshold values change every other year — next time on 1 January 2028. The bill to repeal the Tender Act and introduce a national threshold of DKK 5m (L 113) lapsed at the general election in March 2026, so the Tender Act still applies.
What the BIM executive orders say
- Executive order 118 s. 1(1). Applies to the construction, conversion and extension, renovation and maintenance of buildings and the civil works connected to them, when the estimated construction sum excl. VAT is DKK 5m or more for construction with the state as client (no. 1), construction the state finances with loans or grants of at least 50 % (no. 2), and construction for institutions whose operation the state pays at least 50 % of (no. 3). For regions and municipalities the same applies at DKK 20m (nos. 4–6).
- Executive order 118 s. 1(2). Construction with a commitment of support under the Social Housing Act, the Private Care Homes Act or the Urban Renewal Act is not covered. Social housing follows executive order 119.
- Executive order 118 s. 2. For renovation and maintenance the client may omit one or more requirements if the cost of meeting them is out of proportion to the gains (subsection 1) — but not s. 8 on digital tendering and bidding (subsection 2).
- §§ 3–11. BIM coordination (s. 3) · digital building objects (s. 4) · digital communication and common data environment (s. 5) · building models in design competitions (s. 6) · object-based building modelling in design and construction (s. 7) · digital tendering and bidding (s. 8) · quantities (s. 9) · digital handover (s. 10) · digital defect lists (s. 11).
- Executive order 119 ss. 1–2. Applies to social housing under the Social Housing Act s. 115, renovations under ss. 91 and 92(1) and (3), and design competitions for that construction, when a social housing organisation, a municipality or a region is the client and the construction sum is DKK 20m excl. VAT or more. Ss. 3–11 set the same requirements as executive order 118. There is no exemption for renovation.
Executive order no. 118 of 6 February 2013 applies to building projects started on 1 April 2013 or later. Executive order no. 119 of 7 February 2013 applies to construction with a commitment from the same date. Both are issued under the Public Construction Act and remain in force. Guidance no. 9188 of 6 February 2013 elaborates on the requirements.
How this is calculated
The works contract is assessed on the estimated construction sum excl. VAT. If the build is split into several contracts, it is the total value that counts.
The BIM threshold is DKK 20m or more for municipalities, regions and social housing — and DKK 5m for the state and for construction the state finances by at least 50 %. The phases in the matrix show which agreement the requirement must be in, and when it applies. If a moment has passed, the requirement must be agreed as a variation.
SYNEGRO's fee ladder is tied to the same thresholds: O1 below DKK 3m · O2 DKK 3–5m · O3 DKK 5–20m · O4 DKK 20–40.3m · O5 above DKK 40.3m. The fee for the full service from phase 0 to recommending contractors is DKK 314,000 · 455,000 · 827,000 · 1,199,000 · 1,654,000 excl. VAT.
The contract value is the fee plus options and extensions (the Public Procurement Act s. 30(1)) and other purchases of consultancy of the same type in the case, which are added together (s. 8). A purchase must not be split up to come under a threshold (s. 30(2)).
The climate requirement applies to new build and extensions (BR18 ss. 297–298). Only extensions below 250 m² to detached houses, terraced, linked and semi-detached houses, farmhouses and holiday homes are exempt — extensions to institutions are covered regardless of size.
